Surprisingly few helpdesk calls have been taken on the US Bioterrorism Act since it was enabled, so either the overall effect of the legislation has yet to bite, or it has not caused the disruption predicted.

The US Bioterrorism Act went live on 12th December 03, affecting almost all food and drink being sent to the USA. If you have UK premises used for food and drink as listed in the Act, then you should have registered those premises with the US authorities by now.

The US Food and Drug Administration (FDA) has indicated that over the next few months a 'light touch' approach will be taken relating to enforcement action stating that, "During the phase-in period [until 12 August 2004], FDA and CBP will generally use civil monetary penalties and refusals only in response to repetitive, flagrant and other serious violations." This is welcomed, but the penalty regime is likely to be enforced more strictly as time passes.

FDA Commissioner Mark B. McClellan said, "The goal of the transition policy is to provide complete clarity and education about the new import requirements, and achieve a higher level of U.S. food security without disrupting trade. I am satisfied that this policy guide presents a realistic strategy for facilitating the flow of this essential commerce, as well as holiday food packages, while countering the threat of terrorism."
